9. Subscription Plans and Payment
If you purchase a paid subscription:
Fees are billed according to the plan selected at sign-up;
Payments are due in advance and non-refundable except as required by law;
Subscriptions automatically renew unless canceled prior to the renewal date;
aiARC may adjust pricing with reasonable prior notice.
Failure to pay may result in suspension or termination of your account.
10. Termination
You may terminate your account at any time by contacting us at support@aiarc.dev or through your account settings.
aiARC may suspend or terminate your access if:
You violate these Terms;
You fail to pay required fees;
Continued access poses a security or compliance risk.
Upon termination, your account and associated data may be deleted after a retention period consistent with our Privacy Policy.
11. Disclaimer of Warranties
aiARC provides the Services “as is” and “as available.”
We make no warranties, express or implied, about:
The reliability or accuracy of results generated by the Services;
Continuous or error-free operation;
Fitness for a particular purpose.
You assume full responsibility for your use of the Services and any reliance on the information they produce.
12. Limitation of Liability
To the fullest extent permitted by law:
aiARC and its affiliates, directors, employees, and licensors are not liable for any indirect, incidental, special, consequential, or punitive damages.
aiARC’s total cumulative liability for any claim arising from or relating to the Services will not exceed the amount you paid for the Services during the twelve (12) months prior to the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so these provisions may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless aiARC, Inc. and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of:
Your use or misuse of the Services;
Violation of these Terms;
Violation of any applicable law or third-party rights.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes arising under or related to these Terms will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their exclusive jurisdiction.
15. Export Control and Compliance
You agree not to use or export the Services in violation of U.S. export laws or regulations.
You also represent that you are not located in a jurisdiction subject to U.S. sanctions or designated as a prohibited destination under U.S. law.
16. Updates to These Terms
We may modify these Terms from time to time.
If we make significant changes, we will provide notice through our website or via email.
Continued use of aiARC after changes take effect constitutes acceptance of the updated Terms.
